이 판사는 “토진 스님 등은 도박이 아니라 오락행위였다고 주장하고 있지만 일상적인 공간이 아닌 호텔에서 비교적 장시간 동안 도박을 했고, 도박에 사용된 금액과 소지하고 있는 금액이 상당한 정도였다”며 “도박 자금의 사용처도 분명하지 않은 점 등을 종합하면 일시적인 오락행위였다고 인정하기 어렵다”고 밝혔다.
토진 등은 지난 4월 백양사 방장의 49제를 앞두고 전남의 한 특급호텔에서 도박판을 벌인 혐의로 기소됐다. 이들은 관광호텔 스위트룸에서 술을 마시고 담배를 피우며 13시간여 동안 판돈을 걸고 포커 도박을 했다.
토진과 함께 기소된 승려 의연은 한 인터넷매체 인터뷰에서 “13시간 동안 겨우 맥주 10병 정도만 마셨을 뿐이다. 담배는 개신교에서나 계율로 정해졌을 뿐 신부님들도 담배를 피우고, 불교 계율에서도 어긋나지 않는다”고 변명했었다

도박을 벌여 기소된 토진·의연은 조계종 고위직 승려로 조계종 내 강한 영향력을 행사하는 ‘실천불교승가회(실천승가회)’ 소속이다. 도박 사건 이후에도 토진은 실천승가회 집행위원으로 홈페이지에 올라 있다.
토진은 실천승가회 집행위원장을 지냈고, (사)lotus world의 감사와 조계사 주지를 맡았다. 그는 盧武鉉 정권에서 ‘국방부과거사진상규명위원회 상임위원’도 맡았었다.
1992년 설립된 실천승가회는 불교계 대표적 운동권 단체다. 이 단체는 98년 6월 ‘비전향장기수후원회’, 99년 9월 ‘국보법반대국민연대’, 2001년 3월 친북(親北)단체인 ‘통일연대’, 2005년 2월 ‘평택미군기지확장저지汎국민대책위원회(평택범대위)’등에 참여했었다.
실천승가회는 2005년 5월 경기도 파주시 보광사에 “불굴의 통일애국투사묘역 연화공원”이라는 이름의 간첩·빨치산 墓域(묘역)을 조성, 물의를 빚었다. 묘역의 비석엔 남파간첩을 “義士(의사)”, 빨치산출신을 “애국통일열사”로 표현하며 “애국통일열사 정순덕 선생. 마지막 빨치산 영원한 여성전사...” 등의 碑文(비문)을 새겨 넣었다.
실천승가회는 2005년 9월2일 정동에서 ‘비전향장기수송환 5돌 기념 및 2차 송환촉구대회’를 개최했다. 2004년 12월13일에는 ‘국보법폐지108배 정진’을 통해 “부처님의 위대하신 신력으로 국가보안법이 하루 속히 폐지되도록 해 달라”는 서원문을 발표했었다.
실천승가회는 소위 “宗團(종단)개혁”을 주장하며, 적극적인 조계종 진출을 시도해왔다. 이들은 94년 3월23일 선우도량(대표 도법)과 함께 ‘범종단개혁추진위(범종추)’라는 단체를 결성, 94년 이른바 ‘조계종 사태’에 참여했던 것으로 알려졌다.
불교교단사연구소 소장인 덕산 스님 논문(7·4불교도 시국법회를 주도한 실천불교 전국실천승가회의 정체와 한국불교의 내일)에 따르면, “실천승가회와 선우도량을 주축으로 결성된 범종추와 동조세력들은 94년 조계종단을 소위 개혁한다는 명분으로 宗權(종권)을 장악했다”고 나온다.
“宗權을 장악했다”는 평가에는 논란이 있을 수 있지만, 조계종 내 실천승가회의 영향력은 무시할 수 없는 수준이다. 성관·청화·장적·퇴휴·지선·법안 등 실천승가회 간부들은 각각 학교법인 동국학원 이사, 조계종 교육원장, 조계종 기획실장, 조계종 교육원 교육부장, 조계종 중앙종회회원, 조계종 기획실장 맡았거나 맡고 있다.
실천승가회는 MB정부 출범 이후 반정부 운동에 힘을 쏟아왔다. 2008년 7월4일 소위 ‘국민주권 수호와 권력의 참회를 촉구하는 시국법회’ 등 소위 정부의 종교차별을 규탄하는 불교도집회를 주도했고 실천승가회 등이 주도한 시국법회는 같은 해 8월27일 10만여 명(주최 측 20만, 경찰추산 6만)의 불교도가 참여한 ‘헌법파괴·종교차별·이명박정부규탄汎불교도대회’로 이어졌다. 다만 자승 총무원장 취임 이후 정부와 조계종은 다소 타협적 스탠스를 취하고 있다.
