침팬지와 인간(人間)의 DNA차이는 1.2%에 불과
朴元淳 변호사와 曺國 교수는 자신들이 公人이라는 점을 잊지 말아야
靈長類(영장류)에 속하는 人間(인간)과 類人猿(유인원)은 유전학적으로 매우 유사하다. 일례로 人間과 침팬지 게놈(Genom, 遺傳體)의 DNA 배열은 98.8%가 동일한 것으로 알려져 있다.

그러나 1.2%의 유전자 차이로 人間과 침팬지가 확연히 구별된다. 

즉 침팬지는 침팬지일 뿐이지 人間이 될 수 없다.
 
 朴元淳(박원순) 변호사는 그동안 ‘서울법대’를 다니지 않았음에도 불구하고 ‘서울법대’를 다녔다고 해왔다. 학력논란이 일자 朴 변호사측은 최근 선거 벽보 약력 란에 ‘서울대 문리과 대학 사회과학계열 1년 제적’이라고 명시했다.
 
 여기서 ‘除籍’(제적)이라는 표현도 옳은 표현이 아니다.
 
 朴 변호사는 1975년 긴급조치 9호 선포(5월13일) 직후인 5월22일 학생시위에 가담했다가 학칙 위반으로 ‘除名’(제명) 징계를 받았다. 除籍과 除名은 다르다. 除籍은 무단으로 등록을 하지 않거나 在學(재학)연한을 초과했을 때, 학사경고가 누적됐을 때 받는 행정조치이다.
 
 除籍은 再입학이 가능하지만 除名은 학교의 징계조치로 원칙적으로 再입학이 불가능하다.
 
 최근 朴元淳 변호사에 대한 공개적 지지를 표명한 서울대 曺國(조국) 교수의 경우도 사소한 것으로 보이지만 매우 중요한 부분에서 실수를 한 케이스다.
 
 서울법대 홈페이지에 게재된 曺國의 경력을 보면 2005년 7월1일~2006년 6월30일 기간 동안 미국의 ‘하버드 옌칭 연구소’의 방문학자로 활동한 것으로 되어 있다.
 
 이 내용은 曺國 교수의 홈페이지(http://jus.snu.ac.kr/~kukcho/index.php)와 '하버드 옌칭 연구소' 홈페이지에도 그대로 게재되어 있다.
 
 문제는 지난해 10월5일 출간된 曺國 교수의 著書인 《진보집권플랜: 오연호가 묻고 조국이 답하다》에는 曺 교수가 ‘미국 하버드대학교 방문학자’로 되어 있다는 것이다.
 
 하버드-옌칭 연구소는 발명가이자 美國의 알루미늄 제조회사(Alcoa)의 창시자였던 찰스 마틴 홀(Charles M. Hall)의 유산을 기반으로 1928년 설립되었으며, 그의 뜻에 따라 非영리 단체로서 아시아의 고등 교육에, 특히 문화에 중점을 둔 인문학과 사회과학의 발전에 기여하고 있다.
 
 하버드-옌칭 연구소는 하버드 대학교와 연계하여 프로그램을 운영하고 있으며, 하버드 대학교 컴퍼스 내에 위치하고 있지만, 법적으로나 재정적으로 독립되어 있다.
 
 따라서 曺國 교수가 ‘하버드 옌칭 연구소 방문학자’ 경력을 ‘하버드 대학교 방문학자’로 자신의 著書에 표기한 것은 朴元淳 변호사가 서울법대를 다니지 않았음에도 불구하고, 서울법대를 다녔다고 해온 것과 비슷한 케이스라 할 수 있겠다.
 
 1.2%의 유전자 차이로 人間과 침팬지가 확연히 구별된다. 사소한 문제로 치부해 버릴 수도 있겠지만, 서울시장이 되겠다는 朴元淳 변호사, 그리고 국립대학 교수인 曺國 교수는 이미 한 個人이 아니다. 자신들이 公人이라는 점을 잊어서는 안 될 것이다.
