대법원, '민중민주주의는 북한공산집단과 궤를 같이함'
대한민국을 공산화시키려는 폭력혁명 이론

1998년 3월13일 대법원은 모내기 그림이 이적표현물에 해당한다는 판결을 내리면서 북한정권의 연방제 통일안은 공산화 통일을 의미한다는 점을 분명히 하였다.
 
 <그림 상반부는 북한을 그린 것으로서 통일에 저해되는 요소가 전혀 없이 전체적으로 평화롭고 풍요로운 광경으로 그림으로써 결과적으로 북한을 찬양하는 내용으로 되어 있고, 그림 하반부는 남한을 그린 것으로서 美·日 제국주의와 독재권력, 매판자본 등 통일에 저해되는 세력들이 가득하며 농민으로 상징되는 민중 등 피지배 계급이 이들을 강제로 써래질하듯이 몰아내면 38선을 삽으로 걷듯이 자연스럽게 통일이 된다는 내용을 그린 것이라 할 것이므로, 결국 이는 피지배 계급이 파쇼독재정권과 매판자본가 등 지배계급을 타도하는 민중민주주의 혁명을 일으켜 연방제통일을 실현한다는 북한 공산집단의 주장과 궤를 같이하는 것으로 여겨질 뿐만 아니라, 위에서 본 제작동기, 표현행위 당시의 정황 등 제반 사정을 종합하여 보면, 위 그림은 反국가단체인 북한 공산집단의 활동에 동조하는 적극적이고 공격적인 표현물로서 舊 국가보안법 제7조 제5항 소정의 이적표현물에 해당한다고 봄이 상당하다고 할 것이다.>
 
 이 판결문은 요사이 민노당 등 좌익세력이 주장하는 민중민주주의가 <피지배 계급이 파쇼독재정권과 매판자본가 등 지배계급을 타도하는 민중민주주의 혁명을 일으켜 연방제통일을 실현한다는 북한 공산집단의 주장과 궤를 같이하는 것>이라고 판단한 것이다.

 

민중민주주의는 헌법이 허용할 수 있는 좌파사상이 아니라 대한민국을 공산화시키려는 폭력혁명 이론임을 분명히 한 것이다.
