영토조항 없애자던 사람이 한나라당 원내대표 출마
헌법 제3조는 대한민국이 한반도 유일한 합법정부라는 역사적 정통성의 핵심조항
 헌법 제3조 영토조항 改廢(개폐)를 주장해 온 인물이 한나라당 원내대표 선거에 출마한다. 5월2일 치러질 원내대표 선거에는 현재 안경률(3선·부산 해운대기장을)·이병석(3선·경북 포항북)·황우여(4선·인천 연수)·이주영 의원(3선·경남 마산갑. 사진)이 출마를 준비 중이다. 이 중 이주영 의원은 공개적으로 헌법 3조를 없애야 한다고 밝혀왔다.
 
 헌법 제3조는 “대한민국의 영토는 한반도와 그 부속도서로 한다”고 규정, 이에 따라 북한정권은 反국가단체·반란단체·반역단체로 규정되고 북한주민은 국민으로 규정된다. 북한정권과 북한주민은 헌법 제3조 및 헌법 제4조의 자유민주주적 기본질서에 의한 평화통일 규정과 맞물려 각각 解體(해체)와 解放(해방)의 대상이 된다. 만일 헌법 제3조를 폐지해 북한을 國家(국가)로 인정해 버리면 북한은 미국·영국·중국처럼 대한민국과 별개의 국가가 돼버려 우리는 통일을 해야 할 법적인 근거를 상실케 된다. 따라서 헌법 제3조는 대한민국이 한반도 유일한 합법정부라는 역사적 정통성의 핵심조항으로 평가받는다.
 
 이주영 의원은 국회 내 미래한국헌법연구회 공동대표 자격으로 개헌을 주장해 왔는데 2008년 7월18일 SBS TV 인터뷰에서도 ‘남북 기본합의서 채택과 유엔 동시가입 등으로 남북관계도 변모한 만큼 영토조항을 시대흐름에 맞게 고쳐야 한다는 의견이 많습니다’는 앵커의 멘트가 나간 뒤 “북한지역에 대해서 헌법의 효력이 미치지 못하는 그런 조항을 둘 필요가 있느냐. 헌법 제4조의 평화통일 조항과의 충돌을 막자는 주장이죠”라고 주장했었다.
 
 같은 당 신지호 의원의 19일 1민족1국가2체제 연방제 방식의 통일 주장과 함께 대한민국의 역사적 정통성을 貶毁(폄훼)하는 발언들이 잇따르는 가운데 보수층의 한나라당에 대한 불신은 더욱 커지고 있다.
