고영주 前검사장, 민노당 해산 청원 나선다
“公敵 1호 민노당 해산 국민운동을 선언한다!”

 검사 시절 ‘공안통’으로 이름을 날렸던 高永宙(고영주) 변호사가 민주노동당 해산 청원에 나선다. 高변호사는 검사 시절 대부분 ‘공안 외길’을 걸었고, 김대중·노무현 정권 당시 ‘제거 대상 검사 10걸’ 가운데 1명으로 지목돼 어려움을 겪다가 2006년 2월 서울남부지검장을 끝으로 검찰을 떠났다.
 
 高변호사는 검사 시절 전국교직원노동조합(전교조)의 利敵性(이적성)을 밝혀내고, 대검 공안기획관이었던 1997년에는 한국대학총학생회연합(한총련)을 利敵團體(이적단체)로 규정하는 데 큰 역할을 한 장본인이기도 하다.
 
 高변호사가 이끄는 단체인 ‘국가정상화추진위원회’와 대표적인 애국단체인 ‘국민행동본부(본부장 서정갑)’는 오는 26일 오전 10시 과천 정부종합청사 앞에서 민노당 해산 청원서 제출 기자회견을 갖고 청원서를 법무부에 제출한다.
 
 ‘국가정상화추진위원회’와 ‘국민행동본부’는 미리 작성된 ‘해산 청원서’를 통해 “민주노동당은 목적 및 활동이 모두 민주적 기본질서에 위배되므로, 헌법재판소에 위 정당에 대한 해산심판청구를 할 것을 청원한다”고 정부(법률상 대표자 법무부장관)에 촉구했다.
 
 이들 단체는 “민주노동당이 표방하고 있는 ‘민중민주주의’ 이념은 소위 ‘인민민주주의’나 마찬가지로 프롤레타리아 독재(공산주의)의 變種(변종)으로서 국민 중 일부인 민중계급만의 주권을 주장, ‘국민 전체가 주인이요, 모든 권력은 국민에게서 나온다’는 대한민국 헌법 상의 국민주권주의와 자유민주주의를 부정하는 개념이고, 이미 대법원 판례에 의하여 명백한 利敵(이적)이념으로 판명돼 있다”고 밝혔다.
 
 이어 “민주노동당이 강령에서 표방하는 통일정책은 북한의 고려연방제 통일방안과 같은 것으로서, 대한민국 헌법이 명령하는 자유민주통일 원칙을 위배한 것”이라고 지적했다.
 
 또 “민노당은 新舊강령을 통하여 사회주의 지향, 북한식 연방제 통일, 민중민주주의, 주한미군 철수와 韓美동맹 해체, 자본주의 반대 등을 주장하고 그 목적을 위하여 불법과 난동을 자행, 헌법 제8조의 민주적 기본질서에 위배되는 정당에 해당하므로 해산되어야 한다”고 밝혔다.
 
 이들 단체는 “민주노동당 일반당원의 개별적 행위” 역시 해산의 사유가 된다고 지적했다. 즉 “민주노동당은 당직자들이 간첩 등 공안사건에 연루된 경우가 여러 번 있었으나, 소속 당원들 범행과 관련해 對국민 또는 對정부 사과를 한 적이 없고, 또 해당 당원에 대하여 출당 등 조치를 취한 적이 없으며 간첩을 침투시켜 민노당을 장악하려 한 북한정권에 항의한 적이 없다”고 밝혔다.
 
 이어 “민주노동당은 정상적인 법치국가에서라면 벌써 해산되었어야 할 정당”이라고 강조한 뒤 “정부는 민주노동당이 창당된 지 10여년이 지나도록 민주노동당에 대한 정당해산 심판청구를 하지 않고 있으므로 청원인(단체)이 본건 청원을 하기에 이르렀다”며 “정부 그리고 정부의 법률상 대표자인 법무부장관은 신속히 국무회의 심의를 거쳐 헌법재판소에 정당해산심판청구를 해줄 것을 청원한다”고 덧붙였다.
 
 다음 달 2일 오후 2시 서울 프레스센터 20층 국제회의장에서는 ‘국민행동 2012’ 출범식이 열린다. 이날 역시 ‘왜 민노당은 해산되어야 하는가’를 주제로 고영주 변호사와, 조갑제(기자), 김성욱(기자)씨의 강연이 계획돼 있다.
