北군대식 용어 “지휘원” 사용한 이석기

수원지법 형사12부(부장 김정운)는 17일 열린 ‘이석기 내란음모 사건’ 결심 공판에서 이석기에 대해 징역 12년에 자격정지 10년을 선고하며 “이 의원의 모임은 혁명조직 ‘RO’가 맞고, 이 의원은 총책에 해당하는 지위에 있었다”고 판시했다. ‘곤지암․마리스타 비밀회합이 RO 조직과 무관하고, RO 조직은 실체가 없다’고 주장해 온 변호인 측 주장을 부인하고 검찰 측 의견을 수용한 것이다.
검찰은 124쪽에 달하는 검찰 구형(求刑)의견문을 통해 RO가 실체가 있는 조직인 증거로, 이석기가 참석자를 “지휘원(指揮員)”으로 부른 사실을 제시했다. 지휘원은 통합진보당 당직․직책 등과 무관한, 김일성 회고록에 빈번히 나오는 북한 군대식 용어(用語)이다. 검찰은 구형(求刑)의견문을 통해 이렇게 설명했다.
“곤지암에서 피고인 이석기는 참석자들에게 ‘곤지암 회합’의 의미를 설명하던 도중 “김근래 지휘원, 자네 뭐하는 거야 지금!”이라고 소리치며 피고인 김근래를 질타하고 있습니다.
‘지휘원’은 통합진보당의 당직․직책 등과 전혀 무관할 뿐만 아니라, 김일성 회고록에 빈번히 등장하는 북한 군대식 용어로서, RO가 엄격한 지휘통솔체계를 갖춘 혁명조직임을 단적으로 보여주는 표현입니다.
이에 대해 변호인은 “김근래 지금 오나, 자네 뭐하는 거야 지금!” 또는 “김근래 지금 와, 자네 뭐하는 거야 지금!” 등으로 들린다고 사실을 왜곡하고 있는데, 그 이유는 이석기 피고인이 감정이 격앙된 상태에서 내뱉은 ‘지휘원’이라는 한마디가 곤지암․마리스타 비밀회합의 주최자와 참석 범위, 회합의 목적과 성격 등을 극명하게 드러내고 있기 때문입니다.”
RO에게 국회(國會)는 혁명의 교두보에 불과하며 국회의원(國會議員) 역시 혁명을 위해 맡은 배역일 뿐이다. 실제 이석기는 RO 회합 당시 “이 자리는 의원이고 자시고 중앙당 당직의 지휘부가 다 없는 거예요”라며, 검찰 측 표현에 따르면, “RO 조직에서 국회의원, 중앙당 당직은 ‘각자의 초소’에 불과함”을 드러냈다. 검찰은 구형문에서 이석기가 “최종 결전의 결사를 하자’라고 대남 혁명을 선동하고 있다”며 이렇게 밝혔다.
“이석기 피고인은 2012년 4 총선에 대해 ‘원내 교두보를 확보하는 그런 전략적 구도하에 대담한 혁명의 진출을 했다’고 평가하며 국회를 ‘혁명투쟁의 교두보’로 인식하는 동시에, 군사적 위협국면이 조성되면 ‘뭐 의회? 아무것도 아니지’라며 전시상황에서 의회를 부정하는 태도를 보이고 있습니다.”
검찰은 또 “곤지암․마리스타 회합 녹음파일은 이석기 피고인이 RO 조직의 ‘대표, 총책’임을 여실히 보여주고 있다”며 이렇게 덧붙였다.
“이석기 피고인이 통합진보당의 대표 또는 CNP 그룹의 대표가 아님에도, CNP 그룹과 관련 없는 참석자들까지 이석기 피고인을 ‘대표님’으로 호칭하는 반면, 같이 참석한 김미희, 김재연 의원에 대하여는 따로 소개를 하거나 ‘의원님’으로 호칭한 사실이 전혀 확인되지 않습니다”
RO는 이른바 비밀을 지키기 위한 조직수칙에도 엄격했다. 검찰 求刑의견문 중 일부이다.
“홍순석 피고인은 세포모임에서 휴대폰은 끄고 차는 500미터, 1킬로미터 떨어진 곳에 세우고 걸어서 참석할 것을 지시하고 있는데, 실제로 제보자를 비롯하여 이 법정에 출석한 참석자 모두 휴대폰을 끄거나 휴대하지 않은 채 참석한 사실이 확인되고, 마리스타의 경우 한 사람도 마리스타 주차장에 차를 세우지 않고 멀리 떨어진 곳에 주차를 하거나 대중교통을 이용하는 등 조직보위 수칙이 철저히 준수되고 있습니다."
