검찰청법 제4조는 검사의 직무를 “공익의 대표자로서 범죄수사” 등을 규정하고 “검사는 그 직무를 수행할 때 국민 전체에 대한 봉사자로서 정치적 중립을 지켜야 하며 주어진 권한을 남용하여서는 아니 된다”고 적고 있다.
