채동욱과 아류(亞流)들의 검찰청법 4조 위반

1. 검찰청법 제4조는 검사의 직무를 “공익의 대표자로서 범죄수사” 등을 규정하고 “검사는 그 직무를 수행할 때 국민 전체에 대한 봉사자로서 정치적 중립을 지켜야 하며 주어진 권한을 남용하여서는 아니 된다”고 적고 있다.
2. 채동욱 검찰총장은 혼외자식 논란에 대해 해명(解明)도 감찰(鑑察)도 거부했을 뿐 아니라 이를 “검찰 흔들기”라는 정치문제·이념문제로 몰아갔다.
채 총장의 정치적·이념적 편향은 끝없이 논란이 돼왔다. 지난 4월 국회 인사청문회 당시 박지원 민주당 의원은 “청문회가 아니라 칭찬회(稱讚會)같다”고 했고 같은 당 박범계 의원도 “파면 팔수록 미담만 나온다”고 했다. 문화일보는 17일 사정당국 관계자 말을 인용해 “채 총장은 취임 이후에도 수시로 야당 의원들을 저녁에 만나 술잔을 나누며 흉금을 터놓고 얘기를 나눴다”고 보도했다.
3. 야당의 극진한 대접을 받으며 총장이 된 채동욱 검사는 좌익 운동권 출신의 진재선 검사를 등용해 국정원의 종북(從北)대응 댓글을 선거개입으로 몰고갔다. 진 검사는 현직 검사로서 국가보안법 폐지를 주장해 온 ‘사회진보연대’에 정기적으로 후원금까지 내 온 인물이다. 진 검사가 이끄는 수사팀은 국정원을 ‘잡기 위해’ 경찰이 제출한 동영상 일부를 변조한 짜깁기 수법도 서슴지 않았다.
4. 채 총장은 회초리 들 정도도 아닌 국정원 댓글 사건에 철퇴를 가했다. 반면 민주당의 국정원 직원 매수 논란, 여직원 불법 감금, 노무현 NLL관련 사초 실종 사건엔 솜방망이조차 들지 않았다. 취임 이후 정치적 중립은커녕 헌법과 사실을 무시한 채 왼쪽으로 치달았다.
5. 압권은 “차라리 전설 속의 영웅 채동욱의 호위무사였다는 사실을 긍지로 삼고 살아가는 게 낫다”며 사표를 던진 엑스트라 등장이다. 김윤상 대검찰청 감찰1과장은 14일 자신이 “국민 전체에 대한 봉사자”가 아닌 이미 정치적 중립을 일탈해 온 채동욱의 “호위무사”였음을 자백했다. 세계 어디에도 없는 소위 평검사 회의마저 들끓기 시작했다.
법치(法治)가 아닌 정치(政治)를 쫓는 자들. 검사(檢事) 아니라 조폭의 정서를 따르는 정치 칼잡이들(劍士)의 존재가 드러난 셈이다.
6. 검사들은 피의자에게 저승사자 같은 존재이다. 지난 5년 검찰수사를 받으며 자살한 사람만 33명에 달한다. 이런 검사들이 국민이 아닌 특정이념 그것도 후배들과 술집이나 오가면서 저질·음란·좌경세력 이해관계를 대변하는 한 온 나라는 지옥이 되고 만다. 채동욱과 그 아류들을 법에 따라 처벌할 이유가 여기 있다.
